Delaware House Counsel

Rule 55.1 of the Delaware Supreme Court Rules allows attorneys admitted to another jurisdiction, including foreign jurisdictions, to apply for a Delaware Certificate of Limited Practice that allows the attorneys to practice law as in-house counsel in Delaware.

House attorneys must be employed in Delaware as an attorney working exclusively for a for-profit or a non-profit corporation, association, or other organizational entity. This includes subsidiaries and affiliates. The business must be lawful and cannot involve the practice of law or the provision of legal services.

Attorneys that are newly hired as in-house counsel by an eligible organization must be admitted within 90 days from the date of employment in order to comply with the house counsel rules.
