North Dakota Government Attorneys
North Dakota does not provide special admission rules for government attorneys licensed in other jurisdictions.
However, North Dakota provides a North Dakota Multijurisdictional Practice Rule (MJP) within its rules of professional conduct. MJP Rule 5.5, Comment 1 states that attorneys authorized by federal statute or other federal law to represent the interests of the United States or other persons in any jurisdiction are excluded from the unauthorized practice of law. Comment 3 exempts government attorneys from the unauthorized practice of law when the attorney engages in a temporary practice and is an employee of a client, acts on the client’s behalf, or on behalf of the client’s commonly owned affiliates. This temporary practice does not include temporary practice where North Dakota Pro Hac Vice admission or North Dakota House Counsel registration is required. The house counsel rules do not explicitly provide for government attorneys.
