South Dakota Bar Exam Format

The South Dakota bar exam is a non-UBE exam: two MPTs, five MEE essays, an Indian Law Question, and the MBE. Scores are not portable as a UBE score. South Dakota plans to administer the NextGen UBE beginning July 2027 (current format through February 2027). Confirm current rules with the Board and NCBE.

MBE Score Transfer
South Dakota accepts transferred MBE scores (confirm current limits with the Board).

UBE Score Transfer
South Dakota does not accept legacy portable UBE scores. NextGen transfers are accepted from July 2026 at a minimum of 620.

Grading

Passing Score
Written average of at least 75% on MPT/MEE/Indian Law and MBE scaled score of at least 133. NextGen local cut score: TBA.

Retaking the South Dakota Bar Exam

Unsuccessful applicants may reapply. Confirm attempt limits with the Board.
