South Dakota Government Attorneys

South Dakota does not provide a specific rule for government attorneys, but several other rules allow government attorneys to practice in South Dakota.

The South Dakota rules for Legal Services Organizations allow attorneys to practice for governmentally funded legal aid bureaus or public defender agencies within South Dakota.

The South Dakota rules for Law Professors allow admission for state administrators employed by the South Dakota Unified Judicial System.

South Dakota also provides a South Dakota Multijurisdictional Practice Rule (MJP) within its rules of professional conduct. Comment 16 to that rule provides an interpretation that exempts government attorneys from the unauthorized practice of law.
