Delaware House Counsel

Delaware Supreme Court Rule 55.1 requires a Certificate of Limited Practice as In-House Counsel to practice under Delaware Lawyers’ Rules of Professional Conduct 5.5(d)(1). Confirm current forms and fees with the Clerk of the Delaware Supreme Court.

Eligibility
Applicants generally must be admitted and in good standing in another U.S. jurisdiction, be employed exclusively by a qualifying employer whose business is other than practicing law, have an office or other systematic and continuous presence in Delaware for practice for that employer, and have an employer with a Delaware place of business where employees regularly work (a registered agent alone is insufficient).

Application and renewal
File Form 1 within 30 days of beginning employment, with certificates of good standing, an employer affidavit (Form 2), and the application fee. Practice may continue while the application is pending under the rule. Annual registration and fee requirements apply (confirm current deadline with the Court). See also Delaware MJP and pro hac vice.
